  • Hey guys

    I was a mostly passive observer during the S 1932 battle, and really admire all of your perseverance. I think all of you did very well with the limited time and zero funds that you had. A little bit about myself: I am a physician from India currently doing medical research here. I am currently busy interviewing for the medical residency Match 2006 (for those of you who know or care) and therefore will not be able to spend as much time here as I would like. I myself am not a GC applicant yet but am extremely interested in the cause you guys are taking up and want to see this thing being worked through. I believe our demands are just and fair, and perfectly in line with the American tradition of fairness. Our demands are just waiting to be intelligently articulated and brought to wider public attention, and will resonate well with all lawmakers irrespective of ideology. We will have to be careful about distinguishing our requirements from competing and confusing interests like illegal aliens, security issues and even H1B visa seekers.

    No American, from the most socially conservative Republican to the scared-about-job-loss Democrat will grudge a legal immigrant -who has played by all the rules all the time and pays all taxes- to reduce his immigration wait period from 7 years to 2 years! We have to play on this sense of American fairness (which exists btw to those who are skeptical) and spread the news about our legit demands (and indeed our existence) to the wider American audience. We have to carry this issue from the arena of policy debate to the personal - tell Americans how it feels like for spouses to waste their time and hope, to not be able to buy a home or plan any kind of life beyond the wait period for the green card. We have to tell them that we are not just potentially controversial legislation, but real people, with dreams, hopes, fears and sensitivities- just like them. After all, we are a significant number among their physicians and software engineers, scientists and nurses, professors and graduate students.

    But we should present these facts well to our audience, and not let communication glitches convert a no-brainer into a close contest. We should not let bad English or an unprofessional approach towards lawmakers/ media feed into stereotypes of “cheap labor” class peddled by the anti-immigrant groups. We have to be savvy and creative about our PR. We have to collect funds and organize the enormous mass of people affected by this issue. Among other things, we have to be politically sensitive and not pass judgments on illegal aliens or protectionist Democrats or anti-immigrant groups in our dialogue amongst ourselves or with others.

    I am aware all of this is tall order, but if we can manage this, I think America will give us what we ask for inside of 6 months. I will contribute as much as I can, as will be allowed by my current pressured situation ; ) Like many others here, I can put forth ideas and suggestions. I think I am politically aware and because I (used to) closely follow the general political media, I will probably be able to provide the American perspective on things, which again many others here regularly do.

    No siree Bob, there is a world of difference in Stock and Land/Real Estate. The value of your land is primarily driven by emotions and other intangible benefits.
    But Stocks are generally driven by future earnings and their value determined by P/E. When you buy a stock in a company: You are buying a future earnings in the form of dividend and an equity in the company. The board, CEO and employees of the company helps you get returns in your investment. For a real estate no one works towards your equity except may be you in backyard or your real estate broker.

    I am not saying stocks are not subject to supply and demand. They indeed are as any other commodity that is traded in a market place. But value of stocks can be more assessed fairly from balance sheet and income statement thus investment is more predictable. What differentiates stock from real estate one is how the value of each is assessed.

  • Right, we must avoid the word as much as possible. But then a lot of reqruiters and HRs now seem to educate themselves about the whole EAD thing and seem to be absolutely fine with the EAD.

    Yes, I would insist that jerk to refuse in writing but again ultimately I do not see any option except let it go and look for other oppertunity .

    I believe that as long as interviewing is concerned companies may have the right not to interview particular kind ("EAD holders" for an example) and interview particular kind ("GC Holder for an example..)

    And most of these jerks communicate this thing ("We do not consider "EAD Holder") verbally on phone but they do not dare to say that in writing. I dared one to send me that in writing and still I am waiting for his email after 4 to 5 followups:)

    The Gandhi Protest

    Several readers commented on a posting earlier this week about 200 skilled immigrants from India who tried a Gandhi-like tactic and sent flowers to the government's immigration director for help in moving their green card applications along. The U.S. Citizenship and Immigration Services forwarded the flowers to soldiers recovering at Walter Reed Army Medical Hospital, saying it understood the intent of gesture.

    Here's a sample:

    "I wonder if USCIS really understood why the flowers were sent. It was a symbolic protest by legal immigrants AGAINST the way USCIS treated them. How could they send it in the 'same spirit' to soldiers whom we all empathize with?"

    "What an inspirational act. Too bad the message did seem to have gotten lost in translation. Just imagine what would have happened in WWII if the US would have turned away the immigrating sciencists and engineers. How come some 50 years later, the US is struggling to see the value of inviting the world's best and brightest to immigrate here."

    "I'm sorry that these people were tricked into coming to America with the promise of a welcome and eventually a Green Card. The fact is that H1-B immigrants were brought here in order to replace US workers."

However, in America, its first time after Martin Luther King Jr., that someone has tried to apply Gandhi's way to fight injustice. It is yet not clear that what would be the outcome of this campaign, but there are rumours that USCIS is already discussing internally to reverse the discriminatory decision which caused this embarrassing flower campaign against them.

    "It's amazing to witness that 60 years after Gandhi's demise, his ideology is still relevant. We are sure its gonna remain relevant till there are Lord Wavell's in this world. Lord Wavell's can momentarily laugh thinking that unorganized immigrants are helpless, but when the peaceful protest will demonstrate its political power, they surely will realize what Gandhi and Gandhian ways are all about."

    If you are buying a TV or a home theater, you don't know if it is functioning properly until you use it. And returning it within stipulated "return period" is not only legal but also ethical.

    Some high-end sellers will even guarantee customer satisfaction by allowing a return any time, yes any time if the customer is not fully satisfied with their product. There is nothing unethical about this. That is why these high-end stores charge you a premium in the first place.

    Not allowing return of merchandise reflects the low level of customer service we used to get back home. Obviously that level of service expectaion has been engrained in us so much that we believe returning used merchandise, even when the customer is not satisfied, is unethical.



    Your option? Stay put! Keep paying your montly obligations! Or sell now if you want, and take the 20G hit.

    Foreclosing when you are not in a financial stress in NOT an option. Get it?

    Now that you have your option, go learn how to be a grown up!

    And now that you also know returning used merchandise is fraud, what are you going to do about it? Are you going to change your ways?

  • I am also from India but the point I am discussing here is clearly a violation of law by Outsourcing vendors including IBM (not just Indian companies), TCS, Wipro etc. I work for a medium size consulting firm based in US and on H1 visa ...and I am impacted by these violations and I think I have the right to oppose this act.... to prove my identity shud I tell you my stories in Chennai consulate... or shud I tell u abt my days in b'lore or shud I tell you all abt my 24 years in India.. you can decide :-).

  • Thank you for admitting most of what I stated here true. Actually all of what I stated here as “skills” are based on my experience in IT management over the last decade. If you suddenly found my post to be stereo typing, you were blind to the stereotypes propagated in this forum for a long time.


    You are wrong here. Do you know that companies like TCS/INFY/Wipro offer “blended rates” in the range of $20+/hr for keeping over 70% of staff offshore? Client directly benefits here. I have seen hypocritical companies that took tax benefits from local governments like cities and counties (which came at the expense of property taxes paid by residents of those localities) for job creation and then turned around and outsourced the very same jobs that they were supposed to create to TCS/Wipro/INFY etc., often dismissing the existing contractor pool/employees which involved people of all nationalities including H1-b workers like “TN Man” who couldn’t compete with the $30+ rates for the on-shore workers even if something was available from these vendors. Now to dump people at $30/hr rate, even though talent is locally available - like "TN Man", these vendors will abuse H1 and L1 by securing as many of these visas as they can( which were intended to bring the best and the brightest for american companies), causing Bill Gates to advocate for unlimited H1-bs when in reality, what he needs is a few thousand H1-bs which should be available in normal circumstances, had these companies not been poaching those visas.

    So these offshore companies circumvented the prevailing wages through an industrial practice that should be considered “dumping”, where they dumped green-horns for the greedy clients, because the green-horns don’t have to go through any interviews in exchange of the very low rates. In this case, the people dismissed from the company/contractors were a lot more skilled, yet managers like me would be forced to start from scratch with the new pool, often resulting in delays for strategic initiatives at these companies, but the bean counters at the top never care, since their horizon is the next quarterly earning release, not what the company would do 2 years down the line (and some of these companies are the culprits behind financial crisis today with their very myopic thinking, just a sample was illustrated above)

    The only jobs that were created in those localities due to such corporations in exchange for tax credits often were Indian Grocery shops opening in that locality to cater to those folks from offshore vendors. :D BTW, I don't have anything against them, I like Indian food.

    I have worked with companies where I managed a 50+ member team to execute a project which at another company employing local workforce may have been done with a 12-15 person team (I have managed it both ways and hence I know that as a fact). Now the company employing the 50+ member team will often massage the numbers to show that they saved $x differential per person* 50 for the bean counters and would have secured bonuses for the higher ups because of those paper savings.

    Now I think as a result of people like me interacting with US law-makers, they are getting the true picture of the abuse going on with the current processes. I understand many of you here are concerned about your own career and eventually settling in US, but once you become a permanent resident or US Citizen, you are going to face the same realities. I have seen Indian-americans who went through the GC/Citizenship process becoming some of the the fiercest critics of the current system, because (like "TN Man"), their livelihoods also are threatened by the current process. They suddenly understand that it has nothing to do with the so-called "skill" or "talent" shortage, it has everything to do with what your hourly billing rate is.


    Finally your post is sensible and it paints 100% reality. Btw, do you think there will be changes in system. Heck NO. People get used to cheap $*** who can work 22 hours a day including weekends without pay or working $5 an hour. In the name of market rates, they made IT field less respectalbe than the oldest profession!!

    By the way, instead of cribbing and bickering, how do we tell this stark relaity to the law makers? US needs H1 workers who are genuinie (like most the people in this forum). How do we tell them to reform green cards. How do we contact them ? What channels we have? Law makers needs to aware that how screwed is the green card processing and also they need to be aware how shitholes like TCS/INFY/SATYAM/HCL et all killing a decent profession and driving lot of US citizens, GC holders, H1 out of the jobs.

    The interpretation of the intent of the law by USCIS is flawed and should be reconsidered given the enormous backlogs in various categories.

    1. If the people are allowed to move between the categories it will just move the backlog from one line to another penalizing the ones already in that line.
    2. It does not provides an equal opportunity to the people already in that line to move to other category who are patiently waiting for their turn.
    3. The porting is subject to gaming and the people who know how to work the system will be the most benefitted by this.
    4. It will also eleminate any potential for the spill of visa numbers from Eb2 to Eb3 category as Eb2 itself will be backlogged

    It should be noted that the immigration benefits are associated with a job requirements and not a person's qualifications. Changing a GC category should not be allowed except in certain extraordinary circumstances and through appropriate changes in the law.

    Mpadap, your arguments are valid but not pertinent to what I am trying to do. If a person becomes elligible , he/she must be allowed to apply for the positions matching his qualifications. Only thing is that he should not benefit from the portability of PD.
