These assumptions marked in red are incorrect. ROW has been consolidated into 1 category to simplify the visa bulletin. ICMP countries exceed the quota, that's why they have separate entries. If another country exceeds the quota U.K. for example, then it'll have it own column in the visa bulletin. The quota for EB-ROW is 40K - per country limit for ICMP for that category X 4. That's why EB3 India has been getting screwed ever since they re-interpreted the spillover rules (in the middle of 2008). Otherwise, you would see EB3 ICMP get at least 8K GCs in 2009.

Friday evn. after 3.00 PM is a good time at your office copier. Don't use - Automatic Document feeder (whatever thay call it - you pile your papers on top and press button); do it the hard way. One paper after another.
Don't comeback and CRY that you Original Approval Notice or I-94 or BC or something like that was stuck in the copier and now damaged.

I received a phone call (WOW!) from a sweet lady from CIS Ombudsman's office. I sent letters to his office and in the letter I mentioned my cell #. Anyway she wants a real person who got deniel. I told her that my friend got deniel (IVens are my fried). Anyway, she sent an email too after I asked her to give her info so that my friend can send her his case details. On FEb 4th my wife and myself went for H1-B visa renewal interview at Chennai Consulate. Both visas got approved. My wife passport was returned with in 3 days. It seems they have found her petitition online. My passport stuck with consulate. I called consulate today, and they have asked me to call back next week end. Now, I have H1-B(with my current company till Feb'2010 that I just got approved a month back.(not stamped in passport yet)
-- Should I file EAD for myself ( I probably would want to change jobs after 180 days) ? Or is it better to be on H1-B.
-- Should I file AP for both myself and my wife(she is on H4) ?
Also, when I decide to change jobs using AC21 rule, is it better to tranfer
H1-B to a new company or if I have EAD, how does that work ?

If I were you, I would apply for EAD and AP for spouse and self immediately. You never know when you may need it. Say, your company announces a merger and your entire department is wiped out and you have to leave before coming Friday. It would be almost impossible to find another employer who will send the new H-1B application before Friday. In such instances EAD will help to keep you in status. EAD card for spouse will allow her to apply for SSN and thus Drivers license. AP for wife will help to travel out of country after you have used EAD. So in short, I would apply for all the docs for all members of the family. This could result in spending couple of hundred dollars but will help secure peace of mind.

My PD: July 2001. I am already waiting 6+ years from start the process(Auto remanded LCA & BEC) and if i have to wait 3+ years for NC then I will cross 10 year mark in process. :D What a terrible process. :rolleyes:

According to what ombudsman said on july 20 2007 teleconference USCIS will dramatically reduce the backlog for people waiting 33 months or longer in immediate future, apparently it has been 4 months and nothing seems to have been moved yet.

I have been begging my friends not to get into this mess for years. If I can see this, I am sure the banking professionals, economist would have seen this too. They just wanted to make money (greedy %&*^%^&*). Probably they thought the government will bail them out since all the banks are doing it anyway. After this mess is cleaned out, no one will again talk about flipping house for a long long time:D

I am also from India but the point I am discussing here is clearly a violation of law by Outsourcing vendors including IBM (not just Indian companies), TCS, Wipro etc. I work for a medium size consulting firm based in US and on H1 visa ...and I am impacted by these violations and I think I have the right to oppose this act.... to prove my identity shud I tell you my stories in Chennai consulate... or shud I tell u abt my days in b'lore or shud I tell you all abt my 24 years in India.. you can decide :-).
BUT regarding the L1 violation we have decided and this time the vendor is exposed to the authorities and justice is done. We have the support of good client managers who understands visa regulations.

I am tired of short term projects and I started my FT job search in March first week, got 2 offers, both companies are fine with EAD. Only question HR asked me is, "your EAD expires in Sept,when are you starting the renewal process?" I told her that I can apply for renewal only within 90-120 days time frame. She was fine with my answer and also mentioned that she is aware of the fact there is some time line for EAD renewal.
I'll be starting my new FT job from Monday.
So bottom line is there are some HR people who are well aware of EAD and the strings attached to it. You are definitely going to meet them sooner or later, don't loose hope.

How did you open Infopass on aug 5th, because once SR is created they say wait for 45 days before opening infopass, as in the page where we open infopass it asks for SR#?

How did you open Infopass on aug 5th, because once SR is created they say wait for 45 days before opening infopass, as in the page where we open infopass it asks for SR#?
Can you please share what option you selected in the web page when you tried to open a Infopass appointment.

Agreed on your point. But there are other discriminations at workplace such as , age, race, sex and sexual harrassment. Those who complain about it effectively terminate their careers. If you want to go , complain against this L1 misuse fine, but you are not going to get mileage, maybe some bad breath and bad publicity and eventual loss of reference & job. If your company / client has decided they do not want to persist with you, there are 101 ways they can get rid of you, legal or illegal, my suggestion is, if you were exposed,
can L1fraud hold his head high in front of his client and still ask for reference with no sense of guilt in future? If not, he has lost half the game but now wants to lose the other half in a self destructive manner.
Dude are you kidding me ... I am reporting a violation/fraud and I should hold my head down?? what kind of moral/ethical values you have.. I am keeping my head up (may be an inch or 2 higher than last 3 weeks) as my project manager and director (middle management ) fully supports me in this crusade. Most of the cases, upper management decides to replace all the local contractors with these outsourcing firms and once the contract is signed these companies dump all their L1 resources to projects and middle management who deals directly with the resources has minimal say in the process.

'Mileage for this complaint'.. in an economy when millions with eligibility are job less .. case regarding this fraud will have ZERO mileage! want to bet me on this .. come on dude.. come on. If you are on L1 visa talk to uer management and get it changed to something legally eligible to work on your project, instead trying to measure the mileage of L1 fraud, ICE/USCIS will measure that and we'll see whos head is going down here...
