    Following-up on his earlier observations on EB-1 demand and "spill-down" to EB-2 reported on InfoNet on March 29, 2011 (InfoNet Doc. No. 11032960), Charlie Oppenheim discussed scenarios for EB-2 movement in the coming months. In preparation of the May 2011 Visa Bulletin, DOS will consider the approximately 12,000 unused EB-1 numbers that will "spill-down" to EB-2, EB-2 demand and possible unused numbers, and will consult with USCIS on its processing potential. A quick look by DOS at this point indicates that there is the possibility for greater advancement of the India EB-2 category than had earlier been thought. Doing so will give DOS better visibility into EB-3 upgrade demand in the pipeline, and will better ensure that all visas allowed annually are used. However, a rapid advance could spur a surge in demand that could impact the cut-off dates later in the year. The May Visa Bulletin, generally issued mid-April, will contain a discussion of visa availability projections for the remainder of the year.

    Its good to see some of the Very active members of s-1932 again in this site.
    This site looks very good, I followed the S1932 thread in immigration.com very closely, but was disappointed after its defeat inspite all the guys aggressive enthu and hardwork. As most people i too feel that we failed because of lack of Lobbying. If everyone can contribute for noble cause that will be great. I have a small suggestion I am not sure whether it sounds right to everyone or not, but in order to start collecting the funds i would suggest that Moderator open a new thread/link about the contributions so that members who are joining eveyday in this forum will get the momentum to contribute. It would be good if it has name(Registered name), amount and date and the sum collected so far. This is just my suggestion if it sounds illogic please disregard.

  • The employer will come up with many excuses to not interview a candidate or hire. If the law doesn't allow you to discriminate when hiring based on national origin or EAD or whatever, rejecting candidates even for an interview doesn't make sense.

    Interview is part of the hiring and recruiting processes. Would you say employers putting a job ad saying we will only interview someone from a particular nationality is allowed?

    However, the more important point is we are fighting to get multi-year EAD in IV among other things. The law doesn't allow discrimination based on EAD for hiring. Let the govt lawyers and employers figure it out if not even interviewing candidates because of EAD comes under the purview of hiring or not and if it is legal or not.

    yes, that is our line of logic and understanding. But seeing the number of experiences what we are having in real world, this does not seem to be applying. You are rightaway asked about your work status and they insist till you give them "specific" word - either "GC" or "Citizenship" or "EAD"... If this would have been the real way ( I and all of us wishes that) the these recruiting guys may not dare to insist till you spit the speific word out and that is before interviewing. In my experience, I always had verbal conversation. I have never been sent an email or letter by any company yet regarding their refusal not to even interview me based on EAD. Verbally 5 companies have starightaway told me "they are not considering me as I do not have green card yet - EAD is not enough". My thinking is that they do this because somehow some law may be covering them, we do not know that but they know that, perhaps..:confused:

  • This is my case in brief:
    I resigned from company A (who sponsered by RIR LC, and I-140) about a year back.
    Filed I485 using approved 140 of comapny A in July 07, in the485 application we mentioned the details of the current company I am working in. Got EAD and AP approved. (Company A's management is co-operative and supports me to take back)
    Also got 3yr H1b extension approved for current company based on the approved I140 of company A.

    Now Iam traveling to India. Had an appointment in Chennai consulate . My previous H1B visa expired in 2004.
    Will there be any issues with that much gap 4yrs, in getting stamp?
    Is it an issue not working for GC sponsoring employer?

    If I use AP what are the issues?
    If asked at PoE (Newark EWR) why not working with company A? what should be better answer?
    Please respond.

    Not sure i agree with that statement. The way the spillover trickle is reaching EB2 there is no way EB2 will become current for atleast 5 years so impact on EB3 within a year or two is a incorrect statement

    This is directly not going to impact your I485, indirectly it might if you get pink slip in your new job and then you try to get another job but they reject it because of foreclosure while doing background check. And if you remain unemployed for long time and USCIS rejecting I485 application.

    Also you might end up paying more in future instead of saving anything out of this entire foreclosure ..



    I got your point and I difffer with that. Your point is-only defective items should be returned and I am saying it doesn't need to be defective. As long as you are not completely satisfied you should be able to return it and price is an element in customer satisfaction. That's why stores do price match so you don't need to return their merchandise. Stores that don't do price match deserve their goods to be returned.

  • not true AP filing is not denied just because you have a valid H1 visa. The two are completely unrelated. Also if you have a valid H1 visa carrying a 485 receipt notice while a good idea is not required at all since you hold a valid H1 visa.





    Foreclosure and bankruptcy will not affect your job search... especially in this market.

    If you encounter a situation in future and HR questions you about bad credit or bankruptcy be honest and explain what happened and companies will understand. This is a tough economy and even millionaires are foreclosing because its the smart thing to do in a capitalist economy.

    Similarly applying for bankruptcy is not bad, it is there for a reason. But remember, understand the bankruptcy laws; for example if you owe 100,000 and apply for bankruptcy the chances are the court will make you pay for it. If you owe 1mill then the court knows that you cannot pay and will dissolve it. Same applies for foreclosure, banks will help you if you cannot afford to make the payment. If you can and they think you can, you are screwed. sorry!





    How is giving tax break to the business helping us in the time of recession? If your company is not selling products, it will hire more to do what? The tax cut will simply go to executives and there will be layoffs. Trickle down economy is a scam.
    Did you compare Obama's tax plan with McCain's. Go to CNN and you will that you will get more from Obama than from McCain's tax cut. How is universal health care bad? There are 50million without healthcare here. Soon your company will say that it cannot pay your healthcare plans because it is getting costly. The middle men(insurance companies) maybe eating more of your money than the actual health care costs. The long lines are due to less available doctors, not because of universal healthcare.
